Matrimonial in Chesham Divorce and Civil Partnership Dissolution It is never an easy route to take but once the decision has been taken and there seems no alternative, we at BPS Solicitors Limited are available to offer a clear and invaluable service to bring the marriage to an end with the minimum of acrimony. We will adopt a conciliatory approach and will endeavour to negotiate a satisfactory settlement rather than a litigious battle.
The end of a marriage inevitably brings a variety of losses not least financial. We utilise the assistance of specialist barristers to assist and represent when necessary.
Fixed Price Divorce and Financial Issues Representation Getting divorced can be emotionally and financially draining. As a mark of our appreciation of this we now offer fixed fee divorce. We have introduced a range of fixed price services which we hope will enable individuals to have more control when dealing with these matters.
Fixed Fee Divorce - What Is Included? We offer a fixed price for the work that is necessary. We offer two tailored packages, so if you are divorcing your spouse, or your spouse is divorcing you there is a package to suit your needs. The fixed fee includes a professional service and emotional support when you need it most.
What Is Included In The Fixed Fee Divorce? The price will include all steps from taking your instructions right through to obtaining the Decree Absolute, which is the legal dissolution of your marriage.
Please contact our family team who will arrange an appointment to suit you as best we can. Please telephone 01494 782244 or e-mail angela@bpssolicitors.co.uk or zoe@bpssolicitors.co.uk
What Is Not Included In The Fixed Fee Divorce? The divorce fixed fee does not cover related issues such as financial negotiations or any Court attendances. Court attendances might be necessary if your divorce becomes defended. Our fixed fee representation does not encompass legal advice in relation to issues involving children.
We do however offer a full service for these additional issues. Details are listed further on. We do reserve our righto increase charges if additional work becomes necessary but you will be forewarned of this.
If You Decide To Opt For The Fixed Fee Divorce - What Do I Do Now? Petitioner (if you wish to divorce your spouse)
The price for a petitioner is £1,350 plus VAT and disbursements (i.e. expenses that we have to pay to the court etc). The 'expenses' we refer to are standard for every divorce, and include £550 that we have to pay to the Court. We offer this fixed price on the basis of a total of one hour of personal attendance and a total of 30 minutes telephone communication. Additionally, our fixed fee packages include e mail correspondence and communicating with you to keep you abreast of the progress. The fixed fee petitioner divorce does not cover all eventualities, for example, if your spouse refuses to acknowledge that they have received the petition or a detective is needed to locate your spouses' whereabouts. You will be advised as your case progresses if your matter will progress outside of the fixed fee remit.
We also offer 'bolt ons' to assist you with any additional issues that may arise along the course of your divorce. For example, if you consider that you require or desire more than one hour of personal, face to face attendance then we charge an additional £170 per hour plus VAT for our solicitor Z0e North's time. Our Senior Solicitor Angela Phelans rate is £250 per hour and Lorie Ansell Solicitors rate is £160 plus VAT per hour.
Respondent (if your spouse is divorcing you)
If you have received or expect to receive a divorce petition we are happy to assist you. As a Respondent we offer a fixed fee of £600 plus VAT. There are no Court fees or expenses to pay so payment is a one off fee.
When Do I Need To Pay? We require one half of the fees plus VAT and the court fees (if applicable) at the initial appointment and the remainder at the end of the matter. We accept cheques, direct payments and card payments into our client account. Please ask us if you require the details. The remainder is due when the Divorce Nisi is pronounced. In the event that you decide not to go ahead with the above proceedings, the fees paid upfront are non-refundable but, if the matter has not proceeded to Court, the Court fees will be refunded if this is applicable to your case.
What Do You Charge in the Event That My Spouse and I Want a 'Clean Break' Order? We offer a fixed fee where a clean break order from the Court is required. This is only really appropriate where there are no assets of the parties. The fixed fee for this service is £600 plus VAT. It would also attract a court fee of £50.
Contested Divorce A contested divorce albeit rare, does not fall within the fixed fee and is charged at our usual hourly rates although we are happy to offer a quotation.
